Terms of Service
These Terms of Service govern use of the Sumzilla website, games, accounts, parent and teacher tools, and related services (collectively, the "Service") operated by We Make. By accessing or using the Service, you agree to these Terms.
1. Eligibility and adult responsibility
Sumzilla is designed to be used with adult involvement. Parents, teachers, schools, and other authorized adults are responsible for creating, supervising, and managing access for children where child use is supported.
- Adults must provide accurate information when creating or managing accounts.
- Adults are responsible for activity that occurs through the accounts, profiles, devices, or access methods they control.
- Children must not create adult-managed accounts on their own.
2. Accounts and access
We may offer guest sessions, local progress storage, adult-managed profiles, school-facing tools, and third-party authentication or passwordless login. We may change the account model or authentication methods over time.
When you use an account or login method, you agree to:
- keep access credentials and devices reasonably secure;
- notify us promptly if you believe access has been compromised;
- use only login methods and accounts you are authorized to use;
- avoid impersonating another person, school, or organization.
3. Acceptable use
You may not use the Service to:
- break the law or violate the rights of others;
- upload or submit content that is abusive, harmful, deceptive, or infringes intellectual property rights;
- interfere with the Service, other users, or the operation of our systems;
- attempt to bypass security, rate limits, access controls, or account restrictions;
- scrape, copy, reverse engineer, or exploit the Service except as allowed by law;
- use child profiles to store unnecessary personal information or sensitive information.
4. Student profiles and school use
Where adults create or manage student access, they are responsible for ensuring they have authority to do so and for choosing profile names or identifiers that are appropriate for the age group and use case.
Unless and until Sumzilla expressly supports it, please do not use a child's full legal name, personal email address, or other unnecessary identifiers in profile names or freeform fields.
5. Educational content and availability
Sumzilla is intended to support learning and practice, but it is not a substitute for professional educational, medical, legal, or safeguarding advice. We may change, suspend, or discontinue any part of the Service at any time, with or without notice.
6. Intellectual property
Sumzilla and its content, including the games, software, branding, graphics, site design, copy, and underlying code, are owned by Sumzilla and its licensors and are protected by intellectual property laws. These Terms give you a limited, revocable, non-exclusive right to use the Service for its intended educational purposes.
7. Feedback
If you send us ideas, bug reports, or feedback, you allow us to use that feedback to improve the Service without any obligation to you, unless we separately agree otherwise.
8. Suspension and termination
We may suspend, restrict, or terminate access to the Service if we reasonably believe these Terms have been violated, a user poses a risk to children or other users, a school or parent relationship is no longer valid, or continued access would create legal, operational, or security concerns.
9. Disclaimers
To the maximum extent permitted by law, the Service is provided "as is" and "as available." We do not guarantee uninterrupted access, error-free operation, specific learning outcomes, or that the Service will meet every user's needs.
Nothing in these Terms excludes, restricts, or modifies any rights or remedies that cannot lawfully be excluded, restricted, or modified, including any rights you may have under the Australian Consumer Law.
10. Limitation of liability
To the maximum extent permitted by law, Sumzilla, We Make, and our owners, employees, contractors, and service providers will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to the Service. Our total liability for claims arising out of the Service will be limited to the amount you paid us for the Service, if any, in the twelve months before the claim arose.
Where liability cannot be excluded but can be limited, our liability is limited, to the extent permitted by law, to re-supplying the relevant services or paying the cost of having those services supplied again.
11. Governing law and operator details
Sumzilla is operated by We Make. These Terms are governed by the laws of South Australia, Australia.
You and We Make submit to the non-exclusive jurisdiction of the courts of South Australia, Australia, and any courts that may hear an appeal from those courts.
Nothing in this section limits any non-excludable rights or mandatory protections that apply to you under consumer, privacy, or other applicable law.
12. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we may update the date above, post a notice on the website, or use another appropriate method to notify users.
